Payment Terms and Payments

General Provisions

1.1. These Regulations are drafted in accordance with the Civil Code of the Republic of Moldova and constitute a public offer. Unconditional acceptance (acceptance) of the terms of these Regulations is considered a fact of using the Service. The website www.sporter.md belongs to A.O. “Clubul Sportiv SPORTER” (hereinafter — SPORTER).

1.2. The Regulations are an official document of SPORTER and define the procedure and conditions for providing the Service, which is available to a User who has the necessary equipment to access the Internet. All matters related to access to the Internet network, the purchase and setup of equipment, or the relevant software are not governed by these Regulations and shall be resolved by the User independently and at their own expense, outside these Regulations.

1.3. Relations related to the provision of entertainment services, the information of which is indicated within the Service:
(1) arise directly between the Participant and the Organizer, the provider of the indicated entertainment services;
(2) are certified by the Electronic Ticket;
(3) are confirmed by an e-mail confirming participation in the Event.


Procedure and Conditions for Providing the Service

2.1. Purchase of participation in the race.
Information about the Event is posted within the Service (date/time, schedule, information on how the event is conducted, races, participation conditions, participation fee, etc.).
The Service is provided online by the Organizer or an authorized representative and may be supplemented or modified at any time.

To participate, a person must register on https://sporter.md/ro/ and choose the desired Event:

  • choose the desired race(s);

  • choose the payment method (depending on the Event: cash, bank card, terminal);

  • provide the required details (first name, last name, date of birth, e-mail, etc.).

2.2. Payment for the race (discipline/distance)
2.2.1. After the Buyer has completed all actions specified in clause 2.1 of these Regulations, a secure payment page is loaded, where the Buyer shall:

  • enter the requested details; moreover, the Buyer expressly warrants that they have full rights to make payment using the selected payment sources and shall bear full responsibility in case of breach of such representations and warranties;

  • be informed that online payment is made under maximum security conditions using a payment card as a payment instrument that enables an online transaction. After making the payment, the Buyer will receive a payment confirmation to the e-mail address provided.
    The payment processor uses a secure system based on the latest version of the 3D-Secure security standard, which represents a new global approach to buyer authentication in secure online transactions. This security measure involves redirecting the user at the time of payment to a secure page where authentication of each cardholder is performed by assigning a one-time code for each online transaction. Refunds are made only to the payment card that was used for the purchase. To make a payment, you will need to enter your bank card details. The transfer of this information is carried out in compliance with all necessary security measures. The information is transmitted in encrypted form and stored only on a specialized server of the payment system. The following data will be required to process the payment:
    o Card number (16 digits);
    o Expiration date (month and year);
    o CVC or CVV code (3 digits);
    o First name and last name on the payment card.
    If the card currency differs from the transaction currency (MDL), the conditions of the issuing bank shall apply to the conversion of the amount debited from the card account;

  • confirm the selected order (as applicable, the selected race) by clicking the “Achită” button (or another button, the clicking of which confirms consent to make the payment) and receive authorization confirmation from the bank that issued the card (hereinafter — the “issuing bank”).

The issuing bank may refuse to authorize the payment for specific reasons provided by the legislation in force in the Republic of Moldova, the issuing bank’s rules, the rules of the relevant electronic payment system or international payment systems, where the issuing bank has grounds to suspect that the payment transaction is fraudulent. All issues related to payment processing shall be resolved by the Buyer with the issuing bank independently and at the Buyer’s own expense, outside these Regulations.

2.2.2. The online purchase has a time limit indicated within the Service at the time the race or discipline/distance is selected for the Event. If within 15 minutes the race selection and payment have not been completed, the order is automatically canceled.

2.3. Issuance of payment confirmation for the race (discipline/distance)
2.3.1. After completion of the payment procedure, the user is redirected from the payment page back to the SPORTER web page https://sporter.md/ from which the “payment dialog” for race registration was initiated.

2.3.2. A participation confirmation is sent to the Buyer to the e-mail address provided when selecting the race. By attending, the Buyer confirms and agrees that sending the race confirmation to the indicated e-mail address constitutes fulfillment by SPORTER of its obligations regarding online sale of race entry and provision of services.

2.3.3. The Buyer is solely responsible for the accuracy and correctness of the data provided within the Service and shall ensure necessary and sufficient measures to prevent unauthorized third-party access to the Buyer’s e-mail mailbox.

2.3.4. After purchasing the race entry and receiving the confirmation at the e-mail address indicated by the Buyer, it is necessary to:

  • access the “Cabinetul personal” link and complete the participant declaration (first name, last name, event, participation number confirming that the Buyer has read and agrees with the race participation conditions);

  • print the participant declaration if needed.

2.4. Refund of race registration
2.4.1. Refund of the race entry purchased by the Buyer is possible under these Regulations and in accordance with the rules established by the Organizer.

2.4.2. Purchasing tickets via www.sporter.md, as well as refunding them to buyers, involves expenses borne by Sporter.md in the course of banking transactions.

2.4.3. The Buyer understands and agrees that, in the event of a ticket refund and request for its value, a commission equal to 10% of the purchased ticket value will be withheld. The retained 10% represents the expenses incurred by SPORTER in the race registration refund procedure, actual administrative and banking costs which were not included in the original price.

2.4.4. Given that the service of selling race registrations to the Buyer has been duly provided, SPORTER assumes the right to retain part of the price of race registrations in accordance with Law No. 105 of 13.03.2003 on Consumer Protection.

2.4.5. Refund of the Event registration by the Buyer and reimbursement of its value for reasons other than cancellation or postponement of the Event for which it was purchased is possible only if the following conditions are met cumulatively:

  • the Event Organizer provides for the possibility of refunding race registration;

  • the refund is made no later than 3 days before the date of the event for which the registrations were purchased.

2.4.6. Reimbursement of the race registration value may be requested by the Buyer by means of a written application, submitted depending on the method of purchase, with withholding of the commission specified in clause 2.4.3. In the case of online purchase, the application shall be submitted electronically to http://sporter.md), websites, banking errors, failures of electronic payment systems, etc.;

  • the Service may contain links to other Internet resources, and SPORTER is not responsible for the availability of such resources, their content, or any other consequences related to the use of materials from such resources;

  • the information provided by the Buyer within the Service may be made available to SPORTER and duly authorized representatives for the purpose of fulfilling obligations to ensure the Buyer’s access to the Event and provision of services.

  • 3.7. Changes/Replacements to registration:
    Participant replacements are allowed only within the same distance.
    Application deadline: no later than 30 days before the start date.
    Fee: 50 MDL.
    Changes of the participation distance are not allowed.
    Replacements are made at the SPORTER office (Calea Orheiului 28/1, 2nd floor) or by e-mail with subsequent identity confirmation.

    For legal entities:

    • 3 free replacements after the confirmed list.

    • Thereafter, 100 MDL per replacement.

    • Changes are prohibited during competition week.

    • The distance cannot be changed.

    • A final electronic invoice will be sent after the event.


    Limitation of SPORTER Liability

    4.1. SPORTER shall not be liable:

    • for actions of banks that ensure payment and refunds in accordance with these Regulations;

    • for delays, failures, inability, and lack of promptness of delivery, deletion or failure to save certain data, as well as for non-compliance of the Service with the Buyer’s needs or expectations;

    • for any damages or losses caused to the Buyer, including, without limitation, as a result of certain changes introduced by SPORTER on its web pages or other resources in the course of providing the Service, and as a result of termination or suspension of the Service, deletions, errors, or failure to save certain data, ambiguities and/or lack of reliability of data provided by the Buyer;

    • in the event of force majeure (an impediment beyond the control of the Parties). Force majeure includes, without limitation, natural disasters, military actions, national crisis, strikes in a sector or region, actions/decisions of public authorities that objectively prevent performance under these Regulations, as well as failures in telecommunication and/or energy networks, malware actions, and unscrupulous acts of third parties aimed at unauthorized access and/or disabling of SPORTER software and/or equipment;

    • in case the Buyer violates the rules for attending Events and/or the access rules established by the Organizer of the relevant events.


    Amendment of these Regulations

    5.1. SPORTER is entitled to introduce any amendments or supplements to these Regulations. All amendments and supplements are published on the SPORTER web page at: https://sporter.md/info/rulestickets.

    5.2. Amendments and supplements enter into force from the moment of their publication in accordance with clause 5.1 of these Regulations, unless otherwise established by SPORTER.
